Media Statement - Circus Phoenix Extreme

MidCoast Council has issued a Notice of Intent to Circus Phoenix to vacate the premises it is currently occupying in Forster.
The circus set up and started to operate without having any appropriate approvals to do so.
While a development application to operate on a vacant parcel of land was lodged, it was only done so in the week before the circus intended on operating.
This did not allow time to assess the application in accordance with the Environmental Planning and Assessment Act.
These types of applications take at least six to eight weeks to assess, and require public notification as well as a range of supporting material including a traffic management plan, which had not been submitted in this instance.
The applicants were aware before they arrived in town that their application would not be approved in time for them to operate this week.
Council met circus representatives on site on Tuesday, before they began operating, to indicate they needed to leave the site. The circus then commenced operation and a Notice of Intent to vacate the premises was issued on Wednesday afternoon.
We have a number of circuses that come into town during the year and they all successfully navigate the planning system and gain approvals before they start operating.
