Work in or on a road reserve

We are the roads authority for all roads and bridges in our local area except for the Pacific Highway; Martin Bridge; Dawson River Bridge or Killawarra Bridge. These are the responsibility for the NSW Roads & Maritime Services.

If you want to erect a structure or carry out work in, on or over a public road you will need to obtain approval from the roads authority.  The roads authority will ensure that any work or activity complies with the relevant standards and that the safety of all road users is protected.

Depending on the type of work, you may need to use one of the following applications:

Engineering Works Construction Certificate

An Engineering Works Construction Certificate is required for major civil works associated with development consent. Major works typically, but not always, refers to work to a value greater than $25,000.

Use this form for:

  • Constructing or re-constructing a road, footpath or drainage.
  • Construction works associated with subdivision of land.

Works typically include road or footpath construction, kerb and gutter, drainage, lighting and traffic control devices.

Minor Works in a Road Reserve (Section 138, Roads Act)

Works in Road Reserve refers to anything that disturbs the existing surface of a road or footpath. Minor typically, but not always, refers to work to a value less than $25,000.

Use this form for:

  • Works requiring excavation and restoration of a public road or footpath.
  • Digging trenches or holes within a footpath or road.
  • Installing a structure such as a sign, public seating or artwork.

Work Zone Permit (Section 138, Roads Act)

Work Zone Permits allows temporary use of a public road, footpath or parking space. They are required when working in areas where there is a high pedestrian traffic and a high demand for parking. This includes areas within town centres.

Works typically include:

  • Work on shopfronts such a painting, installing signage or hoardings.  
  • Swinging or hoisting a crane over the road.
  • Placing a skip or bulk waste bin on the road or footpath.
